Rental Agreement

This agreement is made between Waterside Management LLC, hereinafter “the Owners”, and the guest, hereinafter “Renter”. The owners agree to rent to Renter the selected property (hereinafter referred to as “rental”), under the following conditions:

This agreement shall commence on the reservation arrival date and terminate on the reservation departure date.

The Renter agrees to pay the Owners: a deposit, rent, lodging and sales taxes (12%), resort fee ($5.00 per night for campsites or $10 per night for TinyHome/RV Rentals, credit card processing fee (4% of rent RV Site or 5% of rent Tiny House).

In return, the Owners agree to grant use of the property described as RV Site for the dates reserved. Check-in time is 3:00 PM and check-out time is 11:00 AM.

RENT: For nightly, weekly, and monthly rentals, 100% of the rental fee is due at the time of the reservation. Renters & guests must be 25 years and older, unless family.

CANCELLATIONS: All cancellations must be received 14 days in advance to be issued a full refund minus a $10 transaction fee. Any cancellations within 14 days of check-in will result in NO REFUND.

NO REFUNDS FOR EARLY DEPARTURES. Changes to reservations within 14 days of check in will be subject to a change fee of $20/night of reservation length. Guests must have future dates at time of change to honor credit. Reservation credits must be used within 90 days of original reservation, credits will not be moved once a reservation is made. Site numbers are not guaranteed. If the lot is sold the renter will be required to move to an equivalent site. If an equivalent site is unavailable a refund will be applied to the card on file. Rentals of 30 days or more require payment of first month’s rent, taxes and fees at the time of booking. Any reservation 30 days or more will require a 30 day termination notice to receive full refund minus a $10 processing fee. Due to high demand for October, no refunds will be issued for any cancellation.

IMPORTANT INFORMATION: Please be advised the rented Lot, RV, or Tiny Home is privately owned by an individual, and the Waterside Rental Management Team may need to make changes to your reservation due to unforeseen circumstances. This could include utility issues, lot construction, or lot sales. Waterside Management will notify guests of any changes and will try our best to accommodate reservations in an equivalent Lot, RV, or Tiny Home. If we are unable to accommodate your reservation in an equivalent unit, Management will provide you with a full refund to the card on file.

RV REQUIREMENTS & SPECIFICATIONS: Any RVs 2012 and Older must send a picture with RV specifications to our Reservations Office for Management Approval.

Class A – Minimum of 16 Feet

Class B – Must be approved by Management. Please send an email to our Reservations Office ([email protected]). Minimum of 16 Feet – Bumper to Bumper.

Class C – Must be approved by Management. Please send an email to our Reservations Office ([email protected]). Minimum of 16 Feet – Bumper to Bumper.

Fifth Wheel – Minimum Length of 16 feet Livable Space.

Travel Trailers – Minimum Length of 24 feet Livable Space. Does not include hitch/bumper areas.

RV Park Models – Must be approved by Management. Please send an email to our Reservations Office ([email protected]).

RV Lengths are measured by the livable space. All RVs must be modern, commercially manufactured, and presentable in looks and repair – RVs with fading or peeling of paint/decals, noticeable exterior damage or broken exterior parts will not be permitted . Any RVs 2012 and Older must send a picture with RV specifications to our Reservations Office for Management Approval.

Travel Trailer/Fifth Wheel RV Livable Space: The numbers in front of the letters by each floor plan give RV owners the amount of ‘livable space’ inside of the RV. For example: 2250RK: 22 feet of livable space; 2800BH: 28 feet of ‘livable space’. Length measurements do not include hitch or bumpers.

Exclusively Prohibited: Tents, tent campers, pop-ups, truck campers, vehicles on a truck or semi-truck chassis, or such other units not specifically manufactured to be sold as a recreational vehicle including but not limited to fold-out campers and any recreational vehicles not equipped for full utility hookups to water, sewer, and electrical systems. No Semi Truck tow vehicles are permitted within the community. No Tiny Homes/Park Models are permitted in the community without Management Approval.

FREEZE WARNING: In our area, temperatures frequently fall below 36 degrees during the winter. You are liable for the unhooking of your water hoses. If you are not on a winterized site and do not have a heated hose, you will be responsible for the damages to your equipment and Waterside hydrant. During the colder months unhook water hose, drain your water hoses and shut off the water hydrant to prevent overnight freezing.

BOATS & TRAILERS: Only 2 vehicles are permitted per site. All boats, jet skis, trailers, boat trailers must be stored in the Community Storage Area or off site. The parking/storage of any trailer, boat, or other vehicles is not permitted on Lots, RV lots, or Tiny Home Lots. Please see Park Ranger for storage area pricing and payment. PETS: All animals must be on guest registration form and the tenant agrees they are vaccinated. Pets must be kept on a leash or in a contained area at all times. Pets are not to be left unattended outside at your campsite – Pets must be accompanied by an Owner at all times. Pet owners shall pick up and properly dispose of pet’s waste. Pet owners who are found not abiding by the Pet Waste Policy will be subject to a fine of $25.00 per violation. Barking or aggressive pets will not be tolerated, if this becomes an issue it can result in termination of Rental Agreement and no refund of any payments will be issued. No pets are permitted in the pool or on the pool deck. No potbellied pigs, snakes, American Pit Bull Terriers, Rottweilers, Doberman Pinschers, wolf-hybrid dogs (or any mixed breed of any of the foregoing animals), may be brought onto or kept in the Community at any time.

QUIET HOURS: 11:00 pm through 8:00 am must be respected. Please limit driving vehicles and golf carts during these times.

PARKING: Renter agrees to park in the designated parking spot. Parking is limited to 2 vehicles per site. All vehicles and plate numbers must be listed on agreement. Parking on the road or grass at your site is not allowed.

ADDITIONAL STRUCTURES: Any additional structures, canopies, EZ-Ups or tarps will not be allowed. You must consult with Waterside Management prior to doing anything additional to your rental site. All sites must be kept neat and tidy. Waterside at Blue Ridge will be responsible for weekly lawn maintenance. However, it is the renter’s responsibility to have all items removed from the lawn. Violation to this policy may result in eviction with no refund.

GOLF CARTS/ATV’S: ATVs/SidebySides/4Wheelers are not allowed on resort property. Electric golf carts are preferred. If you have a gas golf cart they must be pre-approved. Drivers must be licensed and 16 years or older on golf carts. Please email a picture and specifications of your golf cart to [email protected] for pre approval. ALL GOLF CARTS MUST PROVIDE PROOF OF INSURANCE.

CAMPFIRES: Are to be in designated fire rings only. Please make yourself aware of county burn bans. Make sure to extinguish all fires before going to sleep or leaving the campsite. Cutting down any trees is not allowed.

TRASH: Place BAGGED trash only at the end of campsite along the road between 9:00 AM – 10:00 AM for trash pickup.

SMOKING: Is not allowed in any indoor Waterside at Blue Ridge facility, pavilion, or at pool area. Properly dispose of cigarette ashes and butts.

POND: No swimming is allowed, and pets are not allowed in the pond at any time. Risk of drowning. Fishing is catch and release only.

CREEK: Use at your own risk. Risk of drowning or death. Waterside at Blue Ridge is not responsible for any use. Must have a license to fish in the creek.

MAXIMUM NUMBER OF PEOPLE: Each site has a maximum occupancy limit of 8 people. Any party falsely representing the number of people at their site or exceeding the number paid for may be subject to immediate eviction without refund. Over occupancy is considered a serious violation of this rental agreement.

WEATHER & WINTER CONDITIONS: There will be no refunds due to inclement weather or power outages. We are open year-round with full hookups.

SUBLET: Renter may not sublet site or reassign this rental agreement.

ENTIRE AGREEMENT: This agreement and any attached addendum constitute the entire agreement between the parties and no oral statements shall be binding. It is the intention of the parties herein that if any of this rental agreement is invalid, for any reason, such invalidity shall not void the remainder of the rental agreement.

ATTORNEY’S FEES: In any action or legal proceeding to enforce any part of this agreement, the prevailing party shall recover reasonable attorney’s fees and costs.

INSURANCE: The renter agrees to carry their own comprehensive, liability insurance and vehicle registration on their camper during the term of this agreement. We encourage all renters to purchase traveler insurance.

NO firearms, fireworks, or other incendiary devices are permitted. Renters violating this will be evicted and no refunds will be given.

POOL, HOT TUB, AND PAVILION FACILITIES: The pool, hot tub, pavilion, & fireplace are provided for your use. Renter must follow all posted instructions & hours for this area. The pool is open seasonally, please contact Reservationist for the pool seasonal opening and closing dates.

Pool Hours 8:00 AM – 8:00 PM
No children under the age of 18 permitted in hot tubs at any time.
Children under 16 must be accompanied by a parent/guardian (over 18 yrs) when using pool facilities.
No lifeguard on duty.
Toddlers must have swim diapers on when in the pool.
When using the hot tub, remember there is a certain health risk associated with this facility.
Renters use facilities at your own risk and take full responsibility.
The pool, pavilion and fireplace are for all renters to use. Please be respectful of others and help us keep this area clean.
No glass in the pool area.
No diving in the pool.
No smoking in the pool area. Smoking allowed in the fire pit area.
No pets in the pool.
Must shower before entering the pool or hot tub.

HOLD HARMLESS: The signee, (hereinafter called “Renter”), jointly and severally, in consideration of being permitted to enter onto, use or occupy properties or facilities belonging to or under the control of Waterside at Blue Ridge and such other consideration, such consideration acknowledge as received and sufficient, does hereby agree to waive, release absolutely indemnify and save harmless Waterside at Blue Ridge, it’s servants, employees, officers, directors, contractors, volunteers, and agents from and against all claims, demands, awards, judgments, costs (including legal costs), actions, causes of action and proceeding by whomever made or bought in respect of any personal or bodily injury (including death) to any person and any loss of or damage to any property caused directly or indirectly by or as a result of the Renter, or its family, friends, guests, acquaintances, agents, servants, contractors, employees or any person connected with the Renter, directly or indirectly, expressly or implied, regardless of whether the Renter related person was invited or not, and regardless of whether the Renter is not at Waterside at Blue Ridge.

The terms of this Agreement form shall be construed as the entire agreement and may not be altered, amended, or modified except in writing and signed by all parties hereto. The terms of this Agreement shall be governed by the Laws of the State of Georgia. This Agreement shall continue to be in full force and effect for each and every visit to Waterside at Blue Ridge by the Renter, their family, friends, guests, acquaintances, agents, servants, contractors, employees, or any person connected with the Renter, directly or indirectly, expressly or implied, regardless of whether the Renter related person was invited or not, and regardless of whether the Renter is present or not at Waterside at Blue Ridge.

PAYMENT: Acceptable payment method is credit card. I agree that all rental monies are non-refundable per cancellation policy above. I have read my rights to purchase travel insurance. I have read the foregoing agreement and agree to abide by the above conditions and also verify that the information provided by me is accurate and correct.
